Professional Fiduciary Fees
Hourly Rate
$150/hour (unless governed by law or court order)
Billed in 1/10th hour increments
Fees reflect time, complexity, and scope of service
Client Onboarding and Set-up Fee (Trust Administration and/or Healthcare Agent)
If you choose to move forward, a one-time onboarding and case setup fee will apply, billed at the standard rate of $150/hour, with a minimum charge of $150.
This fee covers document review, intake planning, record setup, and communication protocols to ensure a smooth start.
Onboarding fee applies to all non-court supervised matters.
For court-supervised matters (e.g., probate or conservatorship), fees follow applicable court guidelines.
Non-Court Supervised Trust Administration
Flat fee: 1% of trust estate value Minimum fee: $3,000
For trusts valued under $500,000, billing may revert to the hourly rate if appropriate.
Comfort Fiduciary reserves the right to determine whether the flat fee or hourly billing model will apply at the time of engagement, based on the size, structure, and anticipated needs of the trust.
Extraordinary services (e.g., litigation, complex tax filings, real property sales) may be billed separately at the hourly rate. For certain trusts requiring ongoing management and oversight, Comfort Fiduciary may apply an annual flat fee, with a minimum of $3,000 per year.
The first year’s annual fee is earned in full at the start of administration. In following years, the fee may be prorated based on the level of ongoing involvement. This annual fee generally covers routine administration, including:
Communication with beneficiaries and professionals
Asset oversight and reporting
Coordination of tax and legal needs
Travel and after-hours responsibilities (when reasonably necessary)
Extraordinary situations, such as litigation, audits, contested matters, or significant time spent managing family dynamics may require additional time beyond what is covered by the annual fee. When this occurs, such time may be billed at the standard hourly rate of $150/hour, with clear documentation and communication provided in advance when possible.
Agent Under Power of Attorney/Agent Healthcare Directive
Billed at $150/hour
Applies to both financial and medical decision-making roles:
A financial power of attorney allows me to manage your finances if you're unable to do so yourself. This can include tasks like paying bills, managing bank accounts, handling investments, or working with tax professionals—always with your best interest and instructions in mind. A POA is required.
As your healthcare agent, I step in to make medical decisions on your behalf if you're unable to communicate your wishes. This includes speaking with doctors, coordinating care, and ensuring your values and preferences guide all healthcare decisions. An AHCD form is required.
Guardianship/Conservatorship of the Person/Estate
Services billed at hourly rate. Guardian/Conservator fees are subject to court approval.
Probate Administration
Fiduciary fees for serving as a Personal Representative/Administrator are governed by Probate Code §10810 and computed on a fee base comprised of gross assets, plus receipts and gains, less losses, as follows:
4% of the first $100,000
3% of the next $100,000
2% of the next $800,000
1% of the next $9,000,000
0.5% of the next $15,000,000
Court discretion after $25,000,000
In addition to statutory fees, extraordinary fees may be requested under Probate Code §10811 for services like tax issues, real property sales, and litigation. These fees are billed at the $150 hourly rate.
General Fee Provisions
All fees are subject to periodic adjustment.
Consultant and Reviews - 1 hour no charge; $150 per hour there after
All time spent subject to billing, including but not limited to: all communications (telephone calls, e-mails, etc.) with client, family and friends, medical providers, caregivers, creditors, attorneys, accountants, financial advisors, bookkeeping, investment reviews, document preparation, and personal meetings.
Travel billed at half hourly rate
After-hours, weekend, and federal holiday services may be billed at 1.5 times the standard hourly rate, at the discretion of Comfort Fiduciary.
"After-hours" is defined as any time outside of 9:00 AM to 6:00 PM, Monday through Friday (excluding federal holidays)
Reimbursements and Third-Party Fees
Reasonable out-of-pocket expenses will be reimbursed i.e. notary, certified mailings, etc.
Third-party professional fees (attorneys, CPAs, realtors, etc.) arepassed through at cost
This fee schedule is subject to annual revisions and adjustments with a minimum 30 days written notice. Time billed in 1/10 hour increments.
